Welcome to Ocean's Echelon Yacht Club ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our maritime leisure services and the website at centralutilityatlas.top (the "Service") provided by Ocean's Echelon Yacht Club.

Engaging in a rental or utilizing our Service indicates your consent to these Terms. Should you object to any aspect of these terms, you are advised not to use the Service.

2. Service Overview

Ocean's Echelon Yacht Club offers a variety of high-end yacht charter services, which include but are not limited to:

• Day-long yacht hire
• Evening sea voyages
• Business getaways
• Exclusive gatherings
• Extended yacht charters

We provide these services based on their availability and prevailing weather conditions. We hold the authority to alter or cease our services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To confirm a charter, you must:

• Be of minimum 18 years of age
• Submit valid and comprehensive details
• Remit a required advance payment as detailed in your reservation confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

A charter reservation is considered confirmed when we receive your payment and provide a written acknowledgment. We reserve the full right to decline services at our personal discretion.

3.3 Availability

Charter availability is contingent upon the accessibility of the vessel and suitable marine conditions. We will attempt to honour your booking preferences for date and time to the best of our ability.

4. Payment Terms

4.1 Pricing

All listed fees are in € and encompass prevailing taxes, unless specified otherwise. Note that our rates can change without prior notification.

4.2 Payment Schedule

• Initial Payment: 50% of the full charter fee at the time of booking
• Remaining Balance: Payable 48 hours prior to the departure of the charter
• Additional fees (if any): Payable after the conclusion of the charter

4.3 Payment Methods

We accept key credit cards, bank wire transactions, and verified cheques. Secure, encrypted processes handle our payment operations.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Over 72 hours before departure: Entire refund less transaction fees
• Between 24 to 72 hours before departure: Refund of 50%
• Under 24 hours prior to departure: No refund available

5.2 Weather Cancellations

Should unsafe weather conditions be determined by our captain, we will suggest to:

• Reschedule the charter to another suitable date at no extra charge
• Issue a complete refund if rescheduling cannot be accommodated

5.3 Mechanical Issues

If there are mechanical malfunctions with the designated vessel, we will strive to provide a comparable alternative. When an alternative is unobtainable, you will receive a refund in full.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Heed all instructions from the crew
• Utilize safety gear when instructed
• Inform us about any medical issues that could influence their security
• Stay within the areas assigned on the vessel

6.2 Prohibited Items

The following articles are not permitted on board:

• Containers made of glass
• Forbidden substances
• Weapons or firearms
• Excessive beverages (more than moderate consumption)
• Animals (unless given prior sanction)

6.3 Conduct

Guest behavior should be maintained respectfully. A charter may be ceased prematurely without a refund if passengers' behavior endangers safety or hinders the pleasure of others.

7. Liability and Insurance

7.1 Our Liability

Our accountability is confined to the charter cost paid. We are not liable for:

• Injuries to oneself due to your carelessness
• The disappearance or damage of private possessions
• Indirect, special, or punitive damages
• Delays induced by meteorological conditions or events outside our authority

7.2 Insurance Coverage

We carry comprehensive insurance that covers our fleet and operations. It is incumbent upon passengers to arrange their own travel and personal insurance.

7.3 Assumption of Risk

Participation in our yacht charter signifies your acceptance that maritime activities carry inherent risks and you accept the obligation for your safety and welfare.

8. Modifications and Itinerary Changes

We reserve the right to change itineraries, passageways, or timetables due to weather, safety considerations, or operational exigencies. We will endeavour to offer similar alternative experiences wherever possible.

9. Force Majeure

Our firm holds no responsibility for holdups, cancellations, or alterations stemming from factors beyond our control, such as, but not limited to:

• Extreme weather phenomena
• Natural calamities
• Government decrees
• Harbor closures
• Technical failures

10. Privacy and Data Protection

Your private data management adheres to our Privacy Policy. Your use of our services signifies your agreement to our data collection and utilization as indicated in the Privacy Policy.

11. Intellectual Property

Our website's material, including text, imagery, logos, and diagrams, is subject to copyright and trademark protections. You are prohibited from copying, distributing, or creating derived work without our prior written authorization.

12. Governing Law

The laws of Spain govern these Terms, with legal disputes settled in the courts of Barcelona, Spain.

13. Changes to Terms
